Not all insurance claims need an attorney. However, some clients decide that they want an attorney to manage the entire process. This question varies on what you want.
There is a time when no matter how much you want to move forward the insurance company will not without an attorney. The insurance company has attorneys that they are looking to for advice and a computer system that tells them what they think you will do. So when is the right time?
If you are not happy after a reinspection, the insurer got an engineer, the insurer has requested a Proof of Loss form or an Examination Under Oath, or you believe that statutory penalties (bad faith) may apply to your claim.
Our attorneys work on a contingency fee basis and only charge a fee on the “new money” we get for you. So there is no fee unless we win your case. We advance all of the costs for you, so you pay nothing out of pocket. It takes industry experts to prove your insurance claim. If there is a dispute over the scope of the damages (you say there is more damage than your insurance company) then it makes it difficult for the insurance company to pay for the additional damage if it is fixed. For example, the insurance company says a few shingles are damaged on your roof, but you believe the entire roof needs to be replaced. Documenting the damage with an expert and/or allowing the insurance company an opportunity to inspect is crucial to your claim being paid properly.
